Refund Policy

1. Eligibility for Refunds

At Himalya NextGen Technologies Pvt. Ltd., we strive to ensure absolute satisfaction with our digital solutions. However, given the nature of custom software development and professional services, refunds are evaluated on a case-by-case basis according to the specific milestones achieved and the terms of the Master Service Agreement (MSA) signed by the client.

Eligibility for a refund typically arises when there is a documented failure to deliver project milestones as per the agreed-upon technical specifications or a significant breach of the service level agreement (SLA) by our team.

2. Software Development Services

For custom software projects, our billing is generally milestone-based. Once a milestone is approved by the client and the corresponding payment is processed:

• Pre-Development: 100% refund of the initial deposit is available if the project is cancelled before any technical discovery or architectural design work begins.
• Discovery Phase: If work has commenced on discovery, wireframing, or SRS documentation, the cost associated with these hours will be deducted from any potential refund.
• Active Development: Refunds are not typically provided for milestones that have been completed, reviewed, and signed off by the client's project manager.

3. Consulting & Advisory

Fees for IT consulting, cloud architectural reviews, and security audits are based on professional time and expertise. These fees are generally non-refundable once the consultation session has been conducted or the technical audit report has been delivered to the client.

4. Subscription-Based Services

For SaaS products or ongoing maintenance retainers provided by Himalya NextGen:

• Monthly Plans: You may cancel at any time. We do not provide prorated refunds for the remaining days in the current billing cycle.
• Annual Plans: Refunds for annual plans may be considered within the first 14 days of the subscription, subject to a processing fee and deduction of any setup costs.

5. Project Cancellation

Clients may request to cancel a project at any time. Upon receipt of a written cancellation notice:

1. We will immediately cease all work on the project.
2. A final invoice will be generated for all work completed up to the point of cancellation.
3. Any remaining balance from prepayments, after settling the final invoice, will be refunded within 15 business days.

6. Non-Refundable Items

The following costs are strictly non-refundable:

• Third-party licensing fees (e.g., AWS/Azure credits, API subscriptions purchased on behalf of the client).
• Domain registration and SSL certificate costs.
• Hardware or infrastructure costs specifically procured for the client's project.
• Administrative processing fees.

7. Refund Processing

Approved refunds will be processed via the original payment method (Net Banking, Razorpay, or Wire Transfer). Please allow 7–15 business days for the funds to reflect in your account, depending on your financial institution's processing times.

8. Disputes & Resolutions

In the event of a disagreement regarding service quality or refund amounts, we encourage clients to contact their Account Manager first. If a resolution cannot be reached, the matter will be escalated to our legal department in Dehradun, Uttarakhand, for arbitration according to Indian Law.
